These Terms & Conditions (“Terms”) govern your access to and use of the website of MBBB Nativity Resort (“Resort,” “we,” “us,” “our”), including inquiries, bookings, and other online services (collectively, the “Website”).
By accessing or using the Website, you agree to be bound by these Terms. If you do not agree, please do not use the Website.
1. Definitions
- “Guest/You” means any person who accesses the Website, makes an inquiry, reservation, or uses any Website feature.
- “Booking” means any reservation request or confirmed reservation made through the Website or channels linked from it.
- “Personal Data” includes personal information, sensitive personal information, and privileged information, as defined by applicable Philippine privacy rules (IRR of the Data Privacy Act—RA 10173 (2016)).
2. Website Use; Accuracy of Information
2.1. You agree to provide accurate and complete information when submitting inquiries or making a Booking.
2.2. Information on rooms, rates, amenities, and promotions may change without notice. We aim for accuracy but do not guarantee that all content is always current.
2.3. You may not use the Website for unlawful purposes, including attempts to access restricted systems, introduce malware, or interfere with Website availability.
3. Inquiries and Bookings (General)
3.1. Booking confirmation. A Booking is considered confirmed only when you receive our written confirmation via [email / SMS / booking reference].
3.2. Rates and inclusions. Rates shown may be subject to taxes, surcharges, and/or applicable fees. The final amount payable will be stated in your Booking confirmation.
3.3. Guest requirements. You may be asked to present a valid government-issued ID upon check-in.
3.4. Special requests. Special requests (e.g., bed type, early check-in) are not guaranteed unless expressly confirmed in writing.
4. Payments; Security Deposit; Charges
4.1. Payment methods accepted: [GCash / Bank Transfer / Credit Card / Cash].
4.2. If a deposit is required, it must be paid within the period stated in the Booking instructions to avoid automatic cancellation.
4.3. We may require a security deposit at check-in for incidentals and damages, refundable subject to inspection and applicable deductions.
5. Cancellation, Rebooking, No-Show
5.1. Cancellation window.
- Free cancellation if made at least [10] days before check-in.
- Cancellations made within [10] days before check-in may be charged 70% of the total Booking amount.
- No-show may be charged 100% of the total Booking amount.
5.2. Rebooking. Rebooking is subject to availability and rate differences.
5.3. Force majeure. Events beyond reasonable control (e.g., typhoons, government restrictions) may affect operations. We will coordinate reasonable options consistent with actual circumstances.
6. Resort Rules; Safety; Conduct
6.1. You agree to comply with Resort rules communicated on-site or in booking materials (e.g., pool rules, quiet hours, capacity limits).
6.2. We may refuse service or require a Guest to leave the premises for serious violations of rules, unlawful acts, or conduct that threatens safety.
6.3. You are responsible for minors and companions under your supervision.
7. Guests’ Property; Valuables; Resort Liability (Important)
7.1. Care of personal belongings. You are responsible for safeguarding your personal items.
7.2. No waiver of hotel-keeper responsibility. Any Website term, waiver, or undertaking that attempts to suppress or diminish the legal responsibility of hotel-keepers/inn-keepers for guests’ effects, where applicable under Philippine law, shall be considered void. (Civil Code (1949); see also YHT Realty Corporation v. Court of Appeals (2005)).
7.3. Where the Civil Code provisions on deposit of travellers’ effects apply, the Resort’s responsibility is governed accordingly and cannot be negated by mere posted notices or waivers.
Note: This clause is included to align the Terms with Philippine public policy on inn-keepers’ responsibility; it is not a promise of absolute liability in all situations.
8. Damage, Losses, and Housekeeping Charges
8.1. Guests may be charged for damage to rooms/facilities, missing items, or extraordinary cleaning required due to Guest actions, subject to proper documentation.
8.2. We may withhold or apply the security deposit to cover validated charges.
9. Intellectual Property
All Website content (text, photos, logos, branding) is owned by or licensed to the Resort. You may not copy, reproduce, or use any content for commercial purposes without written permission.
10. Links to Third-Party Sites
The Website may contain links to third-party sites (e.g., maps, booking platforms). We are not responsible for third-party content, policies, or practices.
11. Privacy and Data Protection (Data Privacy Act)
11.1. Collection and purpose limitation. We collect only personal data that is necessary and compatible with declared, specified, and legitimate purposes (e.g., responding to inquiries, processing bookings, guest verification, billing, security, and compliance). (IRR of the Data Privacy Act—RA 10173 (2016))
11.2. Fair and lawful processing; transparency. We process personal data fairly and lawfully, and we aim to provide clear information on the nature and extent of processing. You may have rights including refusal, withdrawal of consent, or objection, subject to lawful bases.
11.3. Consent. Where processing is based on consent, consent must be freely given, specific, and informed, and may be evidenced by written, electronic, or recorded means.
11.4. Retention. We retain personal data only as long as necessary for the declared purpose, for establishment/exercise/defense of legal claims, or for legitimate business purposes consistent with standards, then dispose securely.
11.5. Data sharing and accountability. If personal data is shared or processed by third parties (e.g., service providers), we use reasonable contractual or other means to ensure comparable protection and remain accountable for personal data under our control or custody.

12. Requests for Records / Confidentiality
Any access to records or information (if any) shall be handled in accordance with confidentiality and privacy obligations under Philippine law, including the Data Privacy Act. (Revised Corporation Code (2019))
13. Disclaimers; Limitation of Liability
13.1. The Website is provided on an “as is” and “as available” basis.
13.2. To the extent permitted by law, we are not liable for (a) temporary Website unavailability; (b) delays due to third-party systems; or (c) indirect or consequential damages arising from Website use.
13.3. Nothing in these Terms excludes liability that cannot be excluded under applicable Philippine law.
14. Governing Law; Venue
These Terms shall be governed by the laws of the Republic of the Philippines. Any dispute arising from or related to these Terms shall be filed in the proper courts/fora of Manaoag, Pangasinan, subject to mandatory applicable rules.
15. Changes to These Terms
We may update these Terms from time to time. The “Last updated” date will reflect changes. Continued use of the Website after updates means you accept the revised Terms.
